Terms of Service

1. Agreement

By downloading, installing, or using ForenseKit ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

ForenseKit is developed and operated by FDev, owned by Francisco Deza, based in Lima, Peru.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use ForenseKit subject to the plan you purchased:

  • Demo: Free evaluation, limited to 3 cases with restricted capabilities.
  • Starter / Professional / Complete: Paid plans with varying module access, billed per case, monthly, or annually.
  • Enterprise: Custom licensing for organizations.

The license is bound to a single machine identified by a unique Machine ID generated during installation.

3. Restrictions

You may NOT:

  • Reverse engineer, decompile, disassemble, or modify the Software.
  • Share, redistribute, sublicense, or resell the Software or your license key.
  • Circumvent license validation, activation, or anti-tampering mechanisms.
  • Use the Software for illegal purposes or in violation of applicable laws.
  • Transfer your license to another machine without deactivation and reactivation.

4. Intellectual Property

ForenseKit, including its source code, binaries, detection rules, intelligence packs, documentation, and branding, is the exclusive property of FDev. All rights not expressly granted are reserved.

5. Activation & Internet Requirement

ForenseKit requires an internet connection for initial activation, periodic heartbeat checks (every 72 hours), and intelligence pack updates. The Software will not function without successful activation.

6. Data Collection

ForenseKit collects only: license key, machine ID, email address, and heartbeat timestamps. We do NOT collect, transmit, or access any forensic evidence, case data, or investigation results. All forensic data remains exclusively on your machine.

7. Evidence Integrity

ForenseKit signs evidence packages using Ed25519 digital signatures and SHA-256 hashing. We do not guarantee the admissibility of evidence in any jurisdiction. Users are responsible for following proper chain of custody procedures.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL FDEV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE. Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

10. Subscription & Billing

  • Per Case: One-time payment, no expiration on the license for that case.
  • Monthly: Recurring billing, license valid for 31 days from payment.
  • Annual: Recurring billing, license valid for 366 days from payment.

Failure to renew results in the license expiring. Existing cases remain accessible in read-only mode.

11. No Refunds

All sales are final. No refunds will be issued under any circumstances. We strongly recommend using the free Demo to evaluate ForenseKit before purchasing a paid license.

12. Termination

We may terminate or suspend your license if you violate these Terms, attempt to circumvent license protections, or your payment method fails and is not resolved within 7 days.

13. Governing Law

These Terms are governed by the laws of Peru. Any disputes shall be resolved in the courts of Lima, Peru.
